A. Fees and class enrolment 1. All paid fees are non-refundable and non-transferable unless with our express written consent at our sole discretion. 2. For group classes, a class will be held only if students have enrolled 4 hours before the class time. Enrolled students will be notified 4 hours before the class whether the class will take place.
3. Please note that free cancellations must be made 4 hours before the class. For any late cancellation 1 hour before the class, you may only join an enrolled class within 1 week from the date of absence as a makeup class. Please book with our administrator directly. For a late cancellation within 1 hour before the class or a no show, class credit will be deducted.
4. All packages have expiry dates. It is in our absolute discretion to consider time extension and extra handling charges or fees upon expiry of the package purchased.
B. Your Physical Condition and Safety 1. You should not participate in the physical activities in our studio whilst suffering from any infections or contagious illness, disease or other ailment including but not limited to open cuts, abrasions, open sores or minor infections, where there is any risk that such participation in such condition may be detrimental to the health, safety, comfort of physical condition of other users of premises. 2. You understand that it is your responsibility to consult a physician regarding your ability to participate in the physical activities, and that participating in the physical activities undertaken at us imposes physical demands upon you. You understand that the yoga instruction provided in our sessions may be held in a heated and humid environment, which will impose extra physical demands on you over and above those which you would experience at cooler temperatures and in lower humidity when engaging in any or comparable exercise. 3. Any person who is pregnant, under medication and/or suffering from or having suffered from any medical disability is strongly advised to seek the advice of a qualified medical practitioner before taking part in any physical activities in our premises. 4. No person who is under the influence of drugs or of alcohol is permitted to take part in any physical activities in our premises.
C. Limitation of Liability 1. You should be aware that in participating in the physical activities in our premises there is the risk or possibility of injury. 2. You voluntarily accept the risk of injury involved in such participation and agree that neither we nor any of our teachers or staff shall be responsible for any claims, demands, damages, losses, loss of profit or business, actions or legal proceedings due to death, injury, loss, damage to your person or property or to the person or property of other participants in the physical activities available at our premises; and 3. You hereby agree to defend, indemnify on demand and hold harmless us or any of our teachers or staff from all claims which may be brought against them for any such injuries of claims as aforesaid and all costs and expenses incidental thereto. 4. We are not responsible for any item lost or stolen in our premises for any reason whatsoever. You are solely responsible for taking care of your personal belongings on the premises.
D. Personal Data 1. The personal data provided by you may be used for processing applications, reviewing your package, benefits or services, collection of monthly fees and other payments required under the Terms and Conditions or used in connection with the operation of us for any related purposes. 2. The personal data given by you may be disclosed to any agent, contractor or person who provides administrative, telecommunications, computer and other services to us in connection with the operation of our business. 3. You have a right of access and correction with respect to your personal data in accordance with the Personal Data (Privacy) Ordinance. Your right of access includes the right to obtain a copy of the personal data which you have provided by means of this Agreement. 4. We reserve the right to take photos and video from time to time on our premises, solely for marketing purposes.
